DESIGN AND SERVICES FROM CONCRETION

Name of Supplier: Concretion Ltd

Person or Persons: Commissioning Concretion to design, manufacture and deliver the product hereafter known as the “Client” 

 

Contract: All goods supplied and or services provided by Concretion are sold under these Terms and conditions of Trading, hereafter known as “Terms”. 

 

GENERAL: All tenders and quotations are submitted, and all orders accepted solely upon and subject to the following “Terms” to the exclusion of all other terms and conditions except such (if any) as are specifically accepted by Concretion in writing. Any payment made to Concretion shall be conclusive evidence of acceptance of these “Terms”. Any provision or condition in the buyer’s order form or elsewhere which conflicts with or in any way qualifies or negates any of these “Terms” shall have no effect and these “Terms” shall prevail. No variations to these “Terms” shall be binding unless in writing and signed by an authorised representative of Concretion.  The “Client” should not rely on any other documents or on any oral representations. 

 

QUOTATIONS: All quotations given by Concretion are best estimates based on the information the “Client” provides and the measurements taken by Concretion prior to commencement of manufacture. They are valid for 30 days.  Any free standing or fitted furniture where Concretions furniture is to be fitted or stood is to be removed by the “Client” and at the “Client’s” expense. 

 

DESIGN & DRAWINGS: All the concept designs and or drawings remain the property of Concretion until the full fee is paid by the “Client” to Concretion. We do not offer refunds on Designs as this is considered a bespoke product and covered by the Consumer Rights Act 2015. Images other than the designed furniture incorporated into your concept design are for illustration purposes only and are not included in our quotation. 

 

ORDER CONFIRMATION: An order is binding once the “Client” has received confirmation or acknowledgement. 

 

DELIVERY: Dates are given in good faith and are adhered to as closely as possible but as all products are made to order no responsibility is accepted for any unforeseen delays subsequently arising or for any consequential loss or damage caused to the “Client” or third parties because of any delays for whatever reason. The “Client” should accept reasonable variations of such dates and times. 

 

It is the client’s responsibility to provide at least 48 hours notice if they wish to delay/rearrange the booked installation date. Any cancellations made during the 48 hour period before installation will be subject to a £150 cancellation fee. 

 

Where delivery is refused by the “Client” or is delayed at the request of the “Client” or where Concretion is unable to deliver the Goods due to circumstances beyond its reasonable control, Concretion on giving notification of readiness to deliver shall be entitled to treat the contract as fulfilled and shall place the goods into store. Delivery will be deemed to have taken place for invoicing payment and the passing of risk. 


Products must be inspected before signing the delivery note. Once the product has been delivered and signed for any damage to the product is solely the client’s responsibility.

INSTALLATION: Concretion can provide extra labour at the client’s request which is chargeable per person per day.  It is also the client’s responsibility to provide ample parking arrangements and clear access to the site. The surface must be level, even, clean and dry for installation and is the clients responsibility to ensure surfaces are suitable for installation. Failure to provide suitable surfaces for installation can lead to colour alteration and cracking which is the clients responsibility.  



PAYMENT TERMS: Purchases from our collections must be paid in full before we commence work. All bespoke projects will require a 50% deposit before work will commence. The remaining 50% will be required after the project has been fabricated but before the date of delivery/installation. No refunds will be given once fabrication has commenced. Any changes to design will be added/deducted to the final invoice. All pieces will remain the property of Concretion until paid in full.  Payments will be made by bank transfer.




CANCELLATION OF GOODS BY CONCRETION: Concretion reserves the right to cancel any order at any time for whatever reason, in which case all funds paid by the “Client”, with the exception of the design fees, will be returned to the “Client”. 



SURFACE APPEARANCE: This is a handmade product and due to the characteristics of the materials used, each piece will be unique in terms of surface detail, colour and shade variance from one piece to the next. As these variables are uncontrollable, we can make no guarantee that any samples provided will be exactly the same as the finished piece. This is also true if a project requires multiple cast pieces. Due to the natural shrinkage characteristic of concrete all measurements will be subject to a tolerance of +-2mm. These tolerances will be equalised during installation. Fitting gaps of up to 5mm are required for joints and adjoining walls. If Concretion install the product, these gaps will be filled with a closely matched mortar, grout or silicone. Sealer marks can be seen on larger pieces, these are lines/dust left over from the sealing process. On pieces larger than 2.4×1.2m shadow lines can be seen from boards being joined for the mould. 

 

GUARANTEE: Whilst there is no specific guarantee period, the following points must be highlighted. 1. Concretion will replace defective goods at their discretion free of charge. 2. Any claim made by the Client based upon any defects in the goods, including in the quality or condition must be notified to Concretion as soon as reasonably practical after discovery. The Client must check the goods after delivery with due care and attention and submit any claim in writing to Concretion with images where applicable. 3. Concretion will not be liable for any defect arising from wear and tear, wilful damage, abnormal working conditions, failure to follow our instructions, misuse or alteration or repair of the goods without Concretion’s prior written approval.




LIMITATIONS OF LIABILITY: Concretion shall not be liable to the “Client” for any special, indirect, incidental or consequential damages arising from Products or from a breach of this Agreement. Except as specifically provided in these conditions, no liability is accepted for any direct or indirect costs, damages or expenses relating to damage to property or injury or loss to any person firm or company or for any loss of profits or production arising out of or occasioned by any defect in or failure of goods or materials or parts thereof supplied by the Company Purchaser’s remedies set forth herein are exclusive and the liability of Seller with respect to the breach of this Agreement or any contract entered into between the parties pursuant hereto shall not exceed the price of the Product(s) or part on which such liability is based. To the extent that the laws of any jurisdiction do not permit limitations or exclusions of implied warranties, incidental damages and consequential damages, the above limitations may not apply. In such jurisdictions, the above limitations shall be enforced to the greatest extent permitted by applicable law. 

 

SPECIFICATION: Any goods manufactured to the design quantity measurement or specification of the “Client” or its experts are produced without warranty of any kind except their compliance with the design quantity measurement or specification. The “Client” will unconditionally fully and effectively indemnify Concretion in respect of any claim resulting there from including the infringement of patent, copyright, design, trademark or any other industrial or intellectual property rights resulting from Concretion’s use of the said design or specifications. 

 

DELAY/FORCE MAJEURE: Concretion shall not be liable for failure to perform or for delay in performance due to fire, flood, strike, act of God, act of any governmental authority or of the “Client”, fuel or energy shortage, wrecks or delay in transportation, inability to obtain necessary labour, materials or manufacturing facilities from usual sources or failure of suppliers to meet their contractual obligations or due to any cause beyond its reasonable control. If any such event occurs, Concretion may extend delivery date by a period necessary to overcome the effect of such delay or cancel any purchase order. 

 

SEVERANCE: If any of these conditions or part of a condition is found to be invalid for any purpose it shall for that purpose be deemed to have been omitted without prejudice to the effectiveness of all other conditions or parts of conditions within these “Terms”.



PROJECT LEAD TIME: Concretion will try to deliver non templated items within six weeks of cleared payment, this however is not a guarantee.
